Acceptance of Terms (TOP)
All use of this website, including browsing, shopping, purchasing or any other form of use, is made by SiliconAssets.com contingent on acceptance by the customer only upon terms and conditions set forth in this document. SiliconAssets.com will not accept any other terms and conditions of sale, unless Buyer and SiliconAssets.com have executed a master contract which specifically supersedes and replaces these terms and conditions.
Any term, condition, or proposals hereafter submitted by Buyer (whether oral or in writing) which is inconsistent with or in addition to the terms and conditions set forth hereon is objected to and is hereby rejected by SiliconAssets.com. SiliconAssets.com’s silence or failure to respond to any such subsequent or different term, condition, or proposal shall not be deemed to be SiliconAssets.com’s acceptance or approval thereof. If any provision or portion of this agreement is held to be invalid, illegal, unconscionable or unenforceable, the other provisions and portions hereof shall not be affected.
All sales agreements shall be deemed made in, and shall be governed by, the laws of the State of Florida. The venue for any disputes arising out of any sales agreement shall be Pinellas County, Florida.
Term; Termination (TOP)
These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by SiliconAssets.com without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

SiliconAssets.com may deliver notice to you by means of e-mail, a general notice on the site, or by other reliable method to the address you have provided to SiliconAssets.com.
Order Acceptance (TOP)
Listings on this website are not an offer to sell goods; rather, they are advertisements to receive offers. All offers/orders are subject to review and acceptance by SiliconAssets.com. Your submission of an order and/or receipt of an order confirmation, automated or otherwise, does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell to you. We reserve the right to decline to accept your order and/or to communicate price changes or availability issues to you after you place your order.
Payment (TOP)SiliconAssets.com accepts Visa, Mastercard, PayPal, eChecks (ACH), Certified Checks, Money Orders, Personal Checks and Bank transfers for payment of goods. We reserve the right to refuse any form of payment. Certain orders, as determined by us and based on risk factors, processing costs, or other factors, may not be eligible for all forms of payment types. We will notify you if this is the case prior to accepting your order. Buyer agrees to pay all applicable taxes, duties or other associated fees with regard to the transaction.
Please Note: When using PayPal as a payment method we will only ship to the address provided to us on the payment notification regardless of whether you elected for an alternate address during checkout or not. We do not make exceptions to this as this protects both you and us from fraud.
SiliconAssets.com takes payment via Secure Socket Layer (SSL) processing. Your order and payment information is encrypted and processed securely through our gateway processing service. When ordering from our website, 99% of orders are processed automatically via an automated system ensuring the highest level of security in processing your transaction. We do not have access to your credit card information to ensure your security, nor can we charge you more than the amount that you approve at the checkout process.
Any customer’s order which exceeds $300.00 (U.S.) may be required to obtain pre-approval with an acceptable method of payment as established by our credit and fraud avoidance department. We may require additional verifications or information before accepting any order. We reserve the right to require additional information from you before accepting or processing any order.
Order Processing & Shipment (TOP)
Our goal is to process and ship all orders as quickly as possible once we receive your order. SiliconAssets.com processes orders between the hours of 9am to 5pm EST Monday through Friday. Orders are not processed on weekends or holidays. All orders placed with us follow the following progression:
Order Placement > Order Processing > Order Shipment > Transit Time > Delivery
Order Placement (TOP)
Our website accepts offers/order 24 hours a day, 365 days per year for your convenience. Upon having placed your selections in our cart and electing to checkout, you will be directed to a page to accept these terms of service, verify your order, select your shipping method and make payment. To ensure order accuracy (proper address information, product, order quantity, etc.) and security, orders are managed 100% through our automated system from start to finish. Our secure, automated system verifies your payment information, billing address and your credit card is pre-authorized placing a hold on the funds. No charges are actually made against your card until we approve your order for processing.
Order Processing (TOP)
Our total processing time is based on the amount of time it takes to get payment authorization and process the order for shipment. Once your order is accepted the normal time to process your order is 1 to 2 (business) days for us to process an order before it is sent for shipping, however this is not a guarantee and may take longer based on a number of factors. SiliconAssets.com cannot guarantee same day shipping on any order including Next Day Air services, however expedited shipments are processed quicker than Standard or Free shipments. During this period, your order is thoroughly reviewed by our Credit Card Department to ensure that the order is accurate, the payment method is valid, and you are authorized to use this payment method. Once your order has passed the rigorous review by our Credit Card Department, it is approved for payment and shipment. For security reasons, voice confirmation may be required before we can process your credit card for payment.
Order Cancellation (TOP)
We understand that from time to time customers may have a need to cancel their order with us. While we are happy to cancel orders if notified in writing (email) before the item actually ships, when you submit an electronic order, we are charged fees immediately to process your payment and transaction. As a result, we charge a 15% order cancellation charge. We ship as quickly as possible, and in some cases ship directly from the manufacturer (Tracking may not show for several days even though the item already shipped) and cannot guarantee that we can stop shipment once the order is placed.
Order Shipment (TOP)
Once Processing is complete (Normally 1 to 2 business days), your order will be pulled, packaged and shipped. If the item(s) on your order are in-stock, we will package and ship them as soon as possible from one of our shipping warehouses. This normally occurs within 1 business day of it being released from the Processing phase. Please allow additional time if your order requires assembly by us. If an item(s) on your order is found to be out of stock after the order is placed and we can get the product within 2-5 business days, we will ship you order in its entirety as soon as the product arrives at our warehouse. If we determine that the product will take longer to arrive or is no longer available, we will notify you.
Transit Time (TOP)
SiliconAssets.com ships items from various Distribution Warehouses and Manufacturers Warehouses located throughout the United States, which may or may not be owned or operated by SiliconAssets.com using common carriers including but not limited to USPS, FedEx, DHL and UPS. Once the order is processed and ready to ship, your estimated time of arrival will be determined by the shipping method you selected during the checkout process. Our shipment methods show the approximate delivery time, however we do not guarantee date-specific delivery and do not refund shipping charges based on delays in transit times with the carrier.
Important Shipping Note
We do not have any ownership or management interest in any third party shipping entities, including USPS, FedEx or UPS. You agree that once your package is given to the third party shipper, they are solely responsible for the delivery of that package and recognize that we have no further control over the delivery process. You agree that if you have questions regarding the delivery status of your package you should contact the shipper directly via phone or by visiting their respective websites at www.fedex.com, www.usps.com or www.ups.com.
Delivery (TOP)
Upon delivery of your product, we strongly recommend checking the package contents immediately.
In the event a package arrives with obvious damage, the Buyer should inspect he contents for damage or refuse the package and notify SiliconAssets.com immediately. If the damage is not identified until the carrier has left, the Buyer should notify SiliconAssets.com in no later than (3) business days. Such notice shall be in writing and shall be reasonably detailed. We will contact the carrier for inspection of the damage. Once the claim has been verified, we can initiate the process of getting a replacement to you. The shipper MUST be allowed appropriate time per their policies to investigate all claims including damage and non-delivery claims.
Buyer shall promptly notify SiliconAssets.com, in no event later than five (3) business days after delivery, of any claimed shortages or non-delivery by the carrier. Such notice shall be in writing and shall be reasonably detailed. Failure to give any such notice within such time shall be deemed an acceptance in full of any such delivery by the buyer.
Returns (TOP)
Most items purchased from SiliconAssets.com are automatically covered by our Risk Free 30-day Satisfaction Guarantee. During the 30 day period following the purchase date, the Buyer may return eligible items to us for exchange or refund. The following applies to all returns whether for exchange or refund:
- All returns require that a Return Materials Authorization (RMA) form be completed and signed prior to return, and all instructions on the RMA form must be followed. This form can be obtained at our website at www.siliconassets.com/v/vspfiles/docs/Silicon_Assets_RMA.pdf
- Products must be received at our warehouse within 30 days of the original purchase date for refund or exchange. After expiration of this period all sales are final.
- Buyer is responsible for return merchandise lost or damaged in transit to us. We recommend insuring all returns and using a shipping method which can be tracked.
- Shipping & handling charges are non-refundable.
- Return shipping costs are the sole responsibility of the Buyer.
- Returns for refund will have a restocking fee assessed (See Refunds for details).
Return of Products purchased shall be governed by SiliconAssets.com's Return policies as set forth herein on the date of the invoice, or as otherwise provided by SiliconAssets.com to Buyer in writing. SiliconAssets.com reserves the right to modify or eliminate such policies at any time.
Return Exemptions (TOP)
Certain items are not eligible for return or may have additional terms. Those items are listed here:
- Special Orders – Special order product may not be returned.
- Large Orders – Certain large orders for normal stock products may be considered Special orders based on quantity/value.
- Software – open software may not be returned once opened.
- End of Life / Clearance Items – These items are not eligible for return.
Exchanges (TOP)
Provided the conditions in the Returns section above are met, items may be returned within 30 days from the date of purchase for exchange. We offer two exchange options - Advance Replacement and Direct Exchange.
Advance Exchange – Buyers who need quick replacement may elect to purchase an advance replacement item from our website for immediate shipment using the shipment method of your choice. Buyer will be charged in full plus the new shipping cost based on your selection. On the RMA form, indicate the new order number in the appropriate field. Upon receipt of your return we will issue a full credit to your original method of payment for the purchase price less original shipping costs.
Standard Exchange – Buyers who do not need the product in a hurry or do not want to pay for additional parts up front may elect to return the product to us for direct exchange. Upon receipt of the product back in our warehouse, we will bill your method of payment for only the cost of shipping for the replacement to you using the shipment method of your choice.
Refunds (TOP)
Provided all conditions in the Returns section above are met, items may be returned within 30 days from the date of purchase for refund (After this time we can not issue any refunds); however the following additional conditions apply to refunds:
- Items which are eligible for refund and are subject to a 15% restocking fee.
- Once you place an order requesting that we ship a product to you, shipping fees are non-refundable.
- Additional fees may be assessed if any part of the original shipment is missing, damaged or otherwise unusable or damages our ability to resell the product (i.e. missing cables, manuals, registration cards, packaging, smells like smoke, etc.). We will notify you of these additional charges prior to issuing your refund
Important Refund Notes
Even though we currently have a "Free Shipping" promotion, it does cost us money to ship an item to you. If an item is returned to us for refund or credit, we will give that credit minus the amount we would normally charge for shipping on this product based on our cart settings at the time. Also if a product is returned as undeliverable for any reason, we will issue a refund less the amount we would normally charge for shipping on this product based on our cart settings at the time PLUS any additional return charges.
Disputes (TOP)
In the event that the Buyer has a dispute for any reason, the Buyer agrees that they will mediate the dispute directly with SiliconAssets.com based on the terms provided herein, without exception. Such notice shall be in writing and shall be reasonably detailed.
In the event that the parties cannot reach a satisfactory agreement or with respect to the dispute, SiliconAssets.com may, at our sole discretion, determine that mediation by an objective third party, agreed on by both parties, may be beneficial to resolve the dispute. Buyer agrees to pay all costs involved with the mediation should they accept.
In the event that the customer involves a third-party in the dispute without SiliconAssets.com express approval signed and dated by an Officer of the company, then the Customer shall be responsible to pay a minimum of $150 per hour to compensate for the Company Officer’s time to respond to the third-party.
In the event that it becomes necessary to present a claim for adjudication by a court of competent jurisdiction for any reason, both you and SiliconAssets.com agree that the claim must be filed and adjudicated within the County of Pinellas, State of Florida. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of SiliconAssets.com products) must be commenced within one (1) year after the claim or cause of action arises. By purchasing from us or our site, Customer has agreed to abide by these terms and waived any other rights, including the right to file a Credit Card or other financial dispute. Customer understands that by breaching this agreement they are responsible for all costs associated with the dispute and recovery fees consistent with the Fair Debt Collections Act.
Payment Default (TOP)
Upon any default by the Customer, including but not limited to Non-Sufficient Funds, revocation of funds, including but not limited to Credit Card, PayPal, ACH or any other form of electronic financial disputes, or any other breach of contract, SiliconAssets.com shall have all rights and remedies of a Secured Party under the Uniform Commercial Code, which rights and remedies shall be cumulative and not exclusive. In the event of the Customers default in payment for the Products, the Customer shall be responsible for all reasonable costs and expenses incurred by SiliconAssets.com in collection of any sums owed by the Customer and SiliconAssets.com shall not be obligated to make any further deliveries to the Customer. Such reasonable costs and expenses shall include, but not be limited to, reasonable attorney’s fees, collection fees and court costs. Customer agrees that in the event of a financial dispute, including Credit Card Disputes/Charge Backs, PayPal disputes, NSF checks or other Financial Disputes, the customer shall be assessed a fee of $45 per incident, plus the full amount of the dispute, due immediately. Customer also agrees that revocation of payment without proof of return of the Product constitutes theft of tangible goods and wire fraud (18 U.S.C. § 1343) and will be prosecuted to the fullest extent that the Law allows.
Debt Collection (TOP)
In the event collections become necessary due to a breach of this agreement by the Customer, SiliconAssets.com will provide all information obtained during the course of business, including personal contact and employment information, telephone information or other personal information to agencies authorized by us to collect this debt in accordance with the Fair Debt Collection Practices Act and any Federal or State laws on our behalf.
Pricing & Typographical Errors (TOP)
SiliconAssets.com attempts to be as accurate as possible in our pricing, as well as our typographical and photographical depictions of products we offer; however, we cannot guarantee that product descriptions, specifications, pricing or any other content on SiliconAssets.com is accurate, complete, or current. In the event that a product is advertised with incorrect information including, but nor limited to, pricing, typographical, informational, technical or other errors, SiliconAssets.com shall not be liable for this information In the event of any pricing errors, SiliconAssets.com shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, SiliconAssets.com shall issue a credit to your credit card account in the amount of the charge.

SILICONASSETS.COM HEREBY DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, EXPRESS OR IMPLIED, AS TO THE PRODUCTS, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. SILICONASSETS.COM WILL NOT BE LIABLE FOR ANY DAMAGE, LOSS, COST, OR EXPENSE FOR BREACH OF WARRANTY.
In no event shall SiliconAssets.com or any of its officers, employees or other representatives, subsidiaries or affiliates be liable for any indirect, special, incidental or consequential damages including but not limited to loss of use, loss of data, loss of business or profits. SiliconAssets.com reserves the right to cancel without liability any order, the shipment of which is or may be delayed for more than ninety (90) days by reason of any cause or causes beyond its control as aforesaid. SiliconAssets.com reserves the right in its sole discretion to allocate among the Customers or potential Customers, or defer or delay the shipment of, any Product that is in short supply. SiliconAssets.com makes no representations or warranties, either express or implied, of any kind with respect to products sold on this site. SiliconAssets.com expressly disclaims all warranties, express or implied, of any kind with respect to products sold by us, including but not limited to, merchantability and fitness for a particular purpose.
